Bisphenol A migration

Bisphenol A (BPA) is a chemical that is mixed with other chemicals to manufacture plastics and resins. Bisphenol A (BPA) is typically present in polycarbonate (a high-performance rigid plastic) and sometimes in the form of additives in certain PVC materials. It is noteworthy that human exposure to bisphenol A (BPA) may have adverse effects on the brain, endocrine, and reproductive systems. It is generally believed that compared to adults, young children and fetuses are more susceptible to damage from exposure to bisphenol A (BPA).

In June 2014, the European Union issued Directive 2014/81/EU to limit the use of Bisphenol A (BPA, CAS No. 80-05-7) in toys for children under 36 months of age, or other toys that can be put into children's mouths.

On June 25th, the European Commission decided to strictly limit the migration of bisphenol A through liquid to 0.1 milligrams per liter for toys intended for children aged 3 and below, as well as toys that may be placed in the mouth according to design, in order to enhance the safety of toys.

On May 25, 2017, the European Commission published Directive 2017/898, amending Annex II, Appendix 3 of Directive 2009/48/EC (Toy Safety Directive) concerning Bisphenol A (BPA). The new directive applies to toys intended for children under 36 months old or other toys that can be placed in their mouths. The Toy Safety Directive specifies specific migration limits for chemicals in toys intended for use by children under 36 months of age or other toys that can be placed in their mouths, as listed in Appendix C of Annex II. At present, these chemicals are bisphenol A (BPA), tris (2-chloroethyl) phosphate (TCEP), tris (2-chloropropyl) phosphate (TCPP), and tris (2,3-dichloropropyl) phosphate (TDCP).

The new directive lowers the bisphenol A (BPA) content limit for toys by more than half, reducing the migration limit from 0.1 milligrams per liter implemented in December 2015 to 0.04 milligrams per liter. EU member states must pass and publish relevant laws, regulations, and administrative provisions before November 25, 2018, in order to comply with Directive 2017/898. The relevant legal provisions must be implemented from November 26, 2018.
